What is an Unlawful  Detainer?

An unlawful detainer lawsuit refers to the name of the official court complaint that a landlord makes when they want to evict a tenant. An unlawful detainer is the formal eviction process a California landlord must follow to remove a tenant from a rental property.

What is an Unlawful Detainer Assistant?

"Unlawful Detainer Assistant" means: Any individual who for compensation renders assistance or advice in the prosecution or defense of an unlawful detainer claim or action, including any bankruptcy petition that may affect the unlawful detainer claim or action.  who are representing themselves in an unlawful detainer matter.

Registering an Unlawful Detainer Assistant - Individual

Appointments are required to register as an Unlawful Detainer Assistant.  

Place of Filing: An unlawful detainer assistant shall be registered pursuant to this chapter by the county clerk in the county in which their principal place of business is located, and in which they maintain a branch office.

  • Submit an application if filing as an individual unlawful detainer assistant and answer all questions on application,
  • Appear in person with valid government-issued photo identification such as a driver's license, state identification card or passport.
  • Submit an original bond in the amount of $25,000 executed  by a corporate surety qualified to do business in this state.
  • Shall be accompanied by a bond of twenty-five thousand dollars ($25,000) executed by a corporate surety qualified to do business in this state.

Registering an Unlawful Detainer - Corporation/Partnership

Appointments are required to register as an Unlawful Detainer Assistant.  

Place of Filing: An unlawful detainer assistant shall be registered pursuant to this chapter by the county clerk in the county in which their principal place of business is located, and in which they maintain a branch office.

  • Appear in person with valid government-issued photo identification such as a driver's license, state identification card or passport.
  • Submit the application for registration by a partnership or corporation shall contain all of the following statements about the applicant:
    • Personal information; name, age and telephone number of all corporate officers or general partners - B&P 6403(c)(1)
  • If the general partners or officers have ever been convicted of a felony, or a misdemeanor under Section 6126 or 6127, or found liable under Section 6126.5.
  • If the general partners or officers have ever been held liable in a civil action by final judgment or entry of a stipulated judgment, if the action alleged fraud, the use of an untrue or misleading representation, or the use of an unfair, unlawful, or deceptive business practice.
  • The general partners or officers have ever been convicted of a misdemeanor violation of this chapter.
